What actions can lead to a foreign exchange penalty?

Foreign currency exchange operations represent a considerable foreign exchange risk for companies if they are not managed properly and in strict compliance with the current regulations. In Colombia, the governing body for foreign exchange matters is the Banco de la República, in coordination with the National Tax and Customs Directorate (DIAN) as the control and audit authority.

  • Provision of false or incorrect information in foreign exchange declarations and other mandatory reports.
  • Failure to observe the peremptory deadlines set for filing foreign exchange declarations and channeling foreign currency.
  • Irregularities in the use and management of compensation accounts.

The penalties applicable for these infractions may be pecuniary, through the imposition of substantial fines, as well as restrictive, suspending the possibility of carrying out foreign exchange operations, and may even lead to the blocking of bank accounts. In addition, offending companies are exposed to serious reputational harm that can affect their competitive position in the market.
