Ecuador eliminates the 100% tariff on imports from Colombia

Branches of foreign companies belonging to the special foreign exchange regime for hydrocarbons and mining must carry out, no later than June 30, 2026, the annual update of the equity accounts corresponding to the foreign capital investment registered with the Banco de la República.

In accordance with the applicable foreign exchange regulations, this obligation is fulfilled through the electronic transmission of the Equity Reconciliation – Special Regime through the Foreign Exchange Information System, using as a basis the financial information corresponding to the accounting close of December 31 of the previous year.

Who must comply with this obligation?

The update applies to branches of foreign companies subject to the special foreign exchange regime for hydrocarbons and mining that maintain foreign investment registrations with the Banco de la República.

The purpose of this report is to keep updated the equity information associated with the foreign capital investment and to ensure the consistency of the foreign exchange registrations.

What is the deadline to carry out the update?

The regulations establish a period of six (6) months from the close of the accounting year to carry out the update of the equity accounts.

For this reason, the information corresponding to the close of the 2025 financial year must be reported no later than June 30, 2026.

Aspects to consider regarding supplementary investment to assigned capital

Although the information related to the supplementary investment to assigned capital accounts does not have a specific deadline for filing, it is advisable to report it within the same term set for the equity reconciliation.

This practice helps maintain consistency between the branch’s financial information and the foreign exchange registrations administered by the Banco de la República, and also facilitates the comprehensive update of the foreign investment.

The periodic update of this information helps keep the foreign investment registration with the Banco de la República current and consistent.

In addition, it helps ensure that the reported information properly reflects the branch’s equity situation and facilitates responding to any reviews or information requests related to compliance with foreign exchange obligations.

Recommendations for obligated branches

Before the deadline expires, it is advisable to:

  • Review the reconciliation of the equity accounts subject to reporting.
  • Validate the financial information used to support the update.
  • Verify the consistency between the accounting records and the foreign exchange information previously reported.
  • Confirm the correct transmission of the information through the Foreign Exchange Information System.

An early review can facilitate timely compliance with this obligation and reduce the need for subsequent adjustments.
